You are employed by a construction company who have a large contract let on the basis of bills of quantity under a standard form lump sum building contract. The tender bills included a substantial amount of specialist glazing work, which your company has sublet to a domestic glazing sub-contractor. The subcontract is let on the basis of a lump sum quotation from the subcontractor in the form of a simple letter, which was accepted by your company using a purchase order with the words ‘Please carry out specialist glazing all as of drawings issued’. The Engineer has now issued an Engineer’s Instruction omitting approximately half of the specialist glazing, and replacing it with a proprietary cladding system. He has also instructed you to place an order for the cladding work with a sub-contractor nominated by him. Advise your employer as to the potential contractual implications.
